Schlesinger Law Offices Secure $15.9 Million Jury Verdict in Medical Malpractice Case
Schlesinger Law Offices recently won a $15.9 million jury verdict for a client who lost part or all of three of her fingers and almost all of her toes when a doctor failed to administer treatment in a timely fashion.
"This doctor’s failure to follow the standard of care for her profession caused this young woman to suffer nightmarish injuries. She will never be able to lead a normal life,” said Scott Schlesinger, Hollingsworth’s attorney.
Stephanie Hollingsworth was admitted to Holy Cross Hospital in November of 2008 after her auto-immune disease flared up and caused ulcerations in her feet and pain in her hands. This specific complication is caused when the patient’s blood vessels become inflamed, and can cause considerable permanent damage if not treated soon after it occurs.
Hollingsworth’s doctor neither diagnosed nor treated her with the necessary medication, Cytoxan, in time to save her extremities. This failure led to a progressive deterioration in her condition over the following week. Hollingsworth was severely ill by the time she was transferred to the University of Miami Hospital, and her extremities had turned black with gangrene. Doctors at the University of Miami Hospital treated her with the necessary medication and saved her life, but were unable to save the necrotic tissue.
Hollingsworth was 26 years old when doctors were forced to amputate the tips of two of her fingers, her right thumb, part of her left foot, and nine of her toes.
"It was very clear what happened,” said Schlesinger. “She needed a very specific therapy, and they didn't give it. They dithered. They did needless, unnecessary and harmful invasive testing. All the while, the patient was suffering the consequences."
Hollingsworth now requires prosthetic devices to perform basic daily actions, and cannot stand or walk for more than half an hour at a time. Because of this doctor’s failure to treat her properly, Hollingsworth was forced to give up on her dreams of a career in performing arts.
"Our legal team worked diligently to help the jurors understand the medical records in the case and to ensure that they were not led astray by the revisionist history and after-the-fact justifications presented by the defense."
